Definitions

• “Photo Fuel ” or “we” refers to the owner of the website and service.
• “Photo Fuel” means the design studio service operated by Photo Fuel and accessible through the website Photo Fuel.

• “Designs” refers to the canvases, templates, uploads and AI-generated text or images that you create or store within the service.

Account Creation

To use our design studio service, Photo Fuel, you must create an account on our website and pay the fees. You agree to provide accurate and complete information when creating your account and to promptly update your information if it changes. You are responsible for maintaining the confidentiality of your account information, including your username, password, and for any activity that occurs under your account. Photo Fuel reserves the right to terminate your account or to refuse service to you at any time and for any reason, including if we believe that you have violated these terms and conditions or if we suspect that you have engaged in fraudulent activity. You agree to immediately notify Photo Fuel of any unauthorized use of your account or any other breach of security. Photo Fuel may use a third-party payment processor to process your payment of the fees. You agree to comply with the terms and conditions of the third-party payment processor in connection with your payment of the fees.

Design Studio

Our design studio service, Photo Fuel, is designed to help you create, edit and export designs using templates, your own uploads and AI-assisted text and image tools. AI-generated output is produced automatically, may be inaccurate or incomplete, and may resemble output generated for other users; you are responsible for reviewing anything you publish. You keep the rights to the designs you create. You must own or hold a licence for any material you upload, and you may not use the service to create content that is unlawful, infringing or harmful. Photo Fuel does not guarantee that any design or export will be suitable for a particular purpose. You are responsible for ensuring that your use of our design studio service complies with all applicable laws and regulations. You agree that you will not use our design studio service for any unlawful activity. Photo Fuel reserves the right to suspend or terminate your access to our design studio service if we believe that you have violated these terms and conditions.

Intellectual Property

All intellectual property rights in our design studio service, including but not limited to copyrights, trademarks, and patents, belong to Photo Fuel . You may not copy, modify, distribute, sell, or transfer any part of our design studio service without our written consent. Limitation of Liability Photo Fuel will not be liable for any direct, indirect, incidental, special, or consequential damages arising from or in connection with your use of our design studio service. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, even if Photo Fuel has been advised of the possibility of such damages. In no event shall Photo Fuel ’s total liability to you for all damages, losses, and causes of action, whether in contract, tort (including negligence), or otherwise, exceed the amount paid by you for the use of our design studio service.

You agree to indemnify, defend, and hold harmless Photo Fuel , its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from or in connection with your use of our design studio service or any breach of these terms and conditions. Photo Fuel provides Photo Fuel, on an “as is” and “as available” basis. Photo Fuel does not make any representations or warranties of any kind, express or implied, including, but not limited to, the accuracy, completeness, reliability, suitability, availability, or timeliness of our design studio service or the information provided through our design studio service. Photo Fuel disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, course of dealing, or course of performance. Photo Fuel does not warrant that the design studio service will meet your requirements, be uninterrupted, timely, secure, or error-free, or that any errors in the design studio service will be corrected. You understand and agree that any use of our application is at your own risk.

Entire Agreement

These terms and conditions constitute the entire agreement between you and Photo Fuel regarding the use of our design studio Photo Fuel.

Delivery Policy:

Your access is delivered instantly: the studio, templates and export tools are available in your account the moment your order completes, and a confirmation is sent to you via email within 24 hours. If this service is not right for you, simply call +1 (888) 833-7011 or contact us via email at [email protected] to cancel your order. Charges will appear on your credit card statements as photo-fuel.com. Thank you for your business.

Refund Policy:

In order to obtain your refund, contact customer service by phone or email within 30 days of your receipt of digital product. Your refund will be credited back to your bank account, and may take up to 3-5 business days to show in your statement, depending on the speed of the processing bank.
